Yes. The regs also identify black drum, red drum, and weakfish as other fish with different sizes and numbers for harvest.

Such rules are made to prevent charters from filling your limit for you. They are there to guide you, not to physically catch fish for you.

Just a point of interest: In SE Alaska the skipper and crew can not even fish. Get ready for what is coming Florida. Bummer!!

Why not use your discretion and just give a written warning instead of jamming him up with a more sever charge?

Yeah, unfortunately the intended safety purpose of regulations is sometimes forgotten by government and used to generate money for the general fund.

And in many cases those who make the rules don’t participate in the activity they regulate.

Like all professions, there are unscrupulous guides. If you get one, notify the guide lic. board and local harbor master. I am a retired guide. As a guide, I helped people who could not hold onto the rod for physical and mental reasons, help a child or older client when they could not bring their two pound weight or 60 lb+ halibut up 200 feet. I also as a guide needed to demonstrate how to use a non level wind bait casting reel, how to feel the bottom, how to jig and a host of other activities. Under the current law in most states if I touch the rod or reel, those activities fall under the definition of fishing. Does taking kids, the elderly, disabled and beginner clients out teaching and helping them fish (without my help they could not do), make me an unethical guide,? Remember, under the Captain/guide and crew no fishing laws, I had to break the law to help them?
I have to agree with another fisherman on this sight that stated laws are often written by people with good intentions that have no clue. Would it not have been far better to make a law restricting the number of rigs in the water to the number of paying clients on board.
Just a note: In 15 years of guiding in Alaska as my main business, I have never had more than a handful of clients want me to catch their fish for them. Just food for thought. REMEMBER-Take a kid fishing
