Nowhere in the constitution that I know of is the power given to the people to determine the constitutionality of a law. 40 some years ago there was a 55 mph speed limit imposed on us by the federal government. So it does happen that the feds get involved in state and local laws. The proper way to fight an unconstitutional law is through the courts. That's the way it's been for almost 250 years. It should be good enough for a county sheriff. I also wear a seat belt. And a mask when I feel it's appropriate.

Who is the controlling party in the constitution you’ve read? The one I know of is in place to protect us from the tyranny of government. Not let the federal government walk all over us without substantiation.
Are you saying the federal government imposed a federal speed limit in California 40 some years ago? I’ve never heard of anything like that. That has never happened in any states I’ve ever lived in. Wyoming, Montana, Colorado, Oregon and now Idaho. It is, and always has been, decided by state government. Not the Feds. I wonder why they would do that in some states and not others. Like when you cross the border going in and out of different states and see the speed limit changes on the same highway. 🤷‍♂️

The federal government effectively makes law by withholding (in this case) t***sportation funds, millions of dollars, to states that do not go along with what they want. You know this as well as I do.
Can you name one state that did not impose a 55 mph speed limit?

State? Yes. Several did impose those limits but not all. Federal government? None of them. Refer to FHWA (Federal Highway Administration). The speeds are set according to safety analysis conducted by each state. Montana for one never set a 55 mile per hour speed limit in my lifetime and that’s 66 years. Wyoming has had 55 mph limits on some highways but not others. I can only talk about states I’ve lived in and none of them had 55 mph speed limits set by the federal government. I kind of wonder why, now, those same roads that were deemed unsafe at 55mph, have a current speed limit of 80/85 mph. Probably better cars and highways I would guess. I’m certain it’s not because people are driving more safely now with a cell phone being top priority behind the wheel for many people. The FHWA admits federal government does NOT set speed limits so I guess we can call it what we want. I, personally, don’t know for a fact that they withhold highway funding if each state don’t do what they’re told but I’m not saying you don’t know that as fact. I will say that would be un-constitutional but look at what the federal government does on a regular basis now.
The original point the Sherriff made was a mandate is not a law and what is going on is unconstitutional. He swore an oath to uphold the constitution. Until the constitution is amended to say these mandates are laws he has an obligation to do what he swore to do. Seat belt laws are “laws”. Set speed limits are “laws”. Telling people they have to wear a mask when there’s no proof it helps anything is not a law. Telling people they have to inject an unknown, unproven chemical into their body is not a law. What he’s saying is he don’t believe in the mandates just like many of us don’t and he’s going to do what he swore to do and protect the people according to the constitution and that he, as well as, many other people are not willing to support these, unconstitutional acts and will resist them until they become law according to the constitution. I, for one, hope they never become a constitutional law. I don’t see how they can but I’ve seen several things happen over the last year that I thought could never happen too. 🤷‍♂️

well I would say their is a difference between traffic laws and personal health mandates but as to the seat belt laws and helmet laws I personally never thought it was the governments role in requiring them those both fall into the area of personal responsibility. I wouldn't be for the government requiring all wear coats and hats when the outside temp gets down below a certain level to prevent frost bite either.

yep that is how it happened as I remember it was during the oil crises maybe in the early 1970's an it was an effort to save fuel primarily not lives although it did both. and you are correct they did it by saying any states that didn't have a 55 speed limit would not get any federal highway funds. There some states like Montana and wy. and maybe a couple others who had few people and wide open spaces that did not go along with it but the vast majority of the nation did because they wanted those dollars. Funny how money often changes ones mind on principles once held goes to the integrity of the person or lack of that will be swayed by the almighty dollar

I’m, really, glad to be living in a state again that does not believe in the all mighty dollar being top priority. So many still do and we can see the problems it causes.

I hope you can make the move soon Andy. You’d be very welcome here. I’ll save ya a fish or two and plenty of wild game. Resident tags over the counter for anything you want to hunt or fish for too👍. I just bought a deer and bear tag a couple days ago. $34.00 total for both of em. My elk tag will be $26.00. Less than $60.00 and I can fill the freezer with three animals easy. We’ve taken 6 bears on the ranch so far for 6 h****rs. The longest hunt was less than an hour. Seven wild bull elk so far and 4 of them scored over 350”. Deer season hasn’t started for rifle yet but I got a sweet deal on mule deer hunting now. 30,000 acres land locked by private property and I have permission to go through private to get there. Have to go by myself but easy peasy deer hunt. I’ve been watching several bucks over 150” up there on my way to work every day. A couple close to 200” and nobody hunts them. I’m a meat h****r so I won’t shoot those big ones but there tons of smaller, 100” plus bucks up there. I’ll get my bear at the same time I’m deer hunting. Both season are open at the same time. Bears everywhere. I have three baits I can hunt off of so that’ll be a snap too. Just gotta feed em the night before and they’ll be there. Bear breakfast sausage is awesome. My wife made some this spring out of a bear a guy was gonna throw away😳🤷‍♂️. Heck yeah!!! We’ll take it. If I get another one given to me this year I won’t shoot one. These black bears here are huge. Some close to 500 pounds. That yields around 180 pounds of good breakfast sausage😋. They make good pepperoni sticks and summer sausage too. It’s hard to beat a good smoked young bear roast also.
