If fishing on someone else’s pond without permission, is that trespassing or poaching?

As long as you aren’t keeping the fish and are returning them to the pond then I would guess just trespassing.

Poaching is a fairly ambiguous term that basically means illegally taking wildlife. So technically it is poaching. You are giving yourself an unfair opportunity to catch those fish. And if they are on private property then they most likely belong to someone else. Just my thoughts.

Most land owners will allow you to fish but you have to ask first.

Most?????? Then why do they have it posted?
So they know who's on their land. Some people think if it's there.... they can use it. I've had people leave gates open, leave their litter, build a campsite with a firepit, drive their ATV's all over my hayfield.
No, I don't want them on my property. People that stop and ask..... Sure, there are some nice trout in the brook, catch all you want. Usually all you have to do is ask.
In 30 years of fishing I have still never been turned down when I've asked to fish a pond on private land even when posted. As stated earlier the signs are there so the land owner knows who is on their land most of the time.
And the answer to your question is Illegal!! it doesn't matter.
Just ask before you fish … If you cant ,at least leave a thank you note . But don't go if its Posted .
Either way it's wrong.Just ask for permission,it might surprise you that the owner won't mind in the least.
